November 26, 2012, Damien Lavell Hodges, 33 of Rochester, appeared before Judge Robert Birnbaum at the Olmsted County Courthouse. He was convicted of Drugs in the 2nd Degree- Sale 3 grams or more- cocaine/heroin/meth within 90-day period. He was sentenced to the St. Cloud Correctional Facility for 72 months.
Hodges was also convicted of Drugs in the 5th Degree- Possess Schedule 1,2,3,4- Not a small amount of marijuana, and sentenced to the St. Cloud Correctional Facility for 15 months. He was also convicted of Theft- Take/Drive motor vehicle- no owner consent, and given five years supervised probation and 50 hours community service.
Preston Scott Johnson, 39 of Rochester, was convicted of Domestic Assault and given a stay of imposition. He was sentenced to five years supervised probation, 150 days local confinement with credit for 95 days served, and 100 hours community service.
Jose Guadalupe Garza, Jr., 41 of Rochester, was convicted of DWI- operate motor vehicle with alcohol concentration 0.08 within two hours. He was sentenced to 54 months at the St. Cloud Correctional Facility, which was stayed for seven years. He was given seven years supervised probation, 365 days local confinement, electronic home monitoring for 30 days, and 100 hours community service.
Matthew Manuel Suarez, 24 of Rochester, was convicted of Drugs in the 5th Degree- Possess Schedule 1,2,3,4- Not a small amount of marijuana. He received a statutory stay of adjudication, and was sentenced to five years supervised probation, 50 hours of community service, and 30 days local confinement.
April Lee Wadsworth, 30 of Winona, was convicted of Theft- Take/Use/Transfer movable property- no consent, and was given a stay of imposition. She was sentenced to eight years supervised probation, and 80 hours community service. She was also convicted of Drugs in the 5th Degree- Possess Schedule 1,2,3,4- Not a small amount of marijuana, and given five years supervised probation, 90 days local confinement, and 90 days home electronic monitoring, and 50 hours community service.
John Franklin Brown, Jr., 28 of Rochester, was convicted of Drugs in the 4th Degree, Possess Schedule 1/2/3 except marijuana with intent to sell. He was given a stay of imposition, and sentenced to 15 years supervised probation, 90 days local confinement with credit for 60 days served, and 100 hours community service. He was also convicted of DWI- Operate Motor Vehicle- Alcohol concentration 0.08 within two hours. He was sentenced to the St. Cloud Correctional Facility for 54 months, which was stayed for seven years, seven years supervised probation, 365 days local confinement, and 30 days electronic home monitoring.
Alfred Richard Einberger, III, 34 of St. Cloud, was convicted of Check forgery- offer/possess with intent to defraud (aid/abet). He was sentenced to the St. Cloud Correctional Facility for 23 months.
Erin Marie Einberger, 30 of Rochester, was convicted of Check forgery- offer/possess with intent to defraud (aid/abet). She was given a stay of imposition and sentenced to five years supervised probation, 30 days local confinement, and 40 hours community service.
Brooke Ann Lange, 20 of Kasson, was convicted of Drugs in the 3rd Degree- Possess 3 grams or more cocaine/heroin/Methamphetamine. She was given a stay of imposition, and sentenced to 20 years supervised probation and 60 days local confinement.
Shanna Lee Yungerberg, 31 of Mazeppa, was convicted of Burglary in the 3rd Degree- steal/Commit felony or gross misdemeanor and given a stay of imposition. She was sentenced to five years supervised probation, and 60 days local confinement. She was also convicted of Drugs in the 5th Degree- Possess Schedule 1,2,3,4- Not a small amount of marijuana and given a statutory stay of adjudication. She was sentenced to five years supervised probation.
Nicholas William Bera, 32 of Rochester, was convicted of Domestic Assault- Felony. He was sentenced to 365 days local confinement, which was stayed for 320 days, two years supervised probation, and 100 hours community service.
Myron Bookertalbert Brown, 41 of Rochester, was convicted of Terroristic Threats Disregard Risk. He was sentenced to 365 days local confinement, which was stayed for 362 days, with credit for three days served. He was also given two years supervised probation and 100 hours community service.
Patrick Perez, 21 of Rochester, was convicted of Aid and Abet Damage to Property- 1st Degree, and given a stay of imposition. He was sentenced to five years supervised probation and 81 days local confinement, with credit for 54 days served.
Brett Arthur Rand, 21 of Rochester, was convicted of Possess Pistol/Assault Weapon- conviction or adjudicated delinquent for crime of violence. He was sentenced to 60 months in the St. Cloud Correctional Facility.
Johnathan Ray Smith, 45 of Rochester, was convicted of Attempted Burglary- 2nd Degree- Dwelling. He was sentenced to 24 months at the St. Cloud Correctional Facility. He was also convicted of Burglary in the 2nd Degree- Dwelling, and was sentenced to 43 months at the St. Cloud Correctional Facility.
Erik Vargas, 20 of Rochester, was convicted of Drugs in the 5th Degree-Possess Schedule 1,2,3,4- Not a small amount of marijuana, and was given a statutory stay of adjudication. He was sentenced to five years supervised probation and 150 days local confinement. He was also convicted of Receiving Stolen Property, and given a stay of imposition. He was sentenced to five years supervised probation, and 150 days local confinement.
